Soul Bind: How do you determine Save?

Soul Bind offers a Will Save: Negates. My question is, how do you determine what your Will Save should be? After all, someone can only cast the spell on you if you are dead.

Categories of Will Save
1. Class/HD Base Will Save
2. Will Save from Wisdom (Compute at Raw, w/ Items, or 0?)
3. Class Ability Bonuses
4. Magic Items that your corpse is wearing.
5. Other Bonuses

Soul Bind is in direct conflict with the Clone spell. The Clone spell says that "When the clone is completed, the original's soul enters (the clone) immediately if that creature is already dead."

The text of Clone conflicts with Soul Bind in that Soul Bind states,"The soul, once trapped in the gem, cannot be returned through clone, raise dead, etc..."

While this spell is not used that often, my DM is starting to whip it out on some NPCs, and will on us if he gets the chance. Thanks.

Where's the conflict?

If the original is dead, its soul enters the clone... unless that soul is trapped in a gem.

Um, Hypersmurf, I have always thought that the transfer from Dead Body to Clone would be instantaneous, so if you cast Soul Bind can you still trap the soul of the 'dead character', since his soul has not departed but is once again in a living body...
 

Ah, I see it now. Nevermind. If you had started making a clone, but it hadn't finsished growing yet (not 2d4 months yet), and then you died, became Soul Bound, and then your clone finished growing, your sould would not return. The spells aren't in conflict; the designers had to allow for having an incomplete clone.

Do both of you see what I am talking about?
