A DM needs to be able to say 'no' sometimes.I wasn't trying to fight rules with rules. I was trying to introduce a situation where the tactic is suboptimal. This is to counterbalance the situations where the tactic is awesome. This is more fun than simply saying 'No.'
This 'tactic' removes minions as an option from the DM's encounter design palette. IMHO minions are kinda neat, and I don't want anything to exist which renders them irrelevant.
Your solution stinks of GOTCHA gaming, which I dislike.
To each his own, I guess.
