Spring Attack while Flying?

Just a quick rules question that came up in our game last night....

If a character is flying, using a fly spell, and they have spring attack, can they use the feat while airbourne, or would they need flyby attack for this?

How about if the same character is on a magic carpet? Can they fly up on the carpet, attack and move back with Spring Attack?

Thanks!
Ellie.

You can use spring attack feat while flying. Fly-by Attack feat is easier to take if you are a race with fly movement mode, and you can do any one standard action, not just an attack.

In case of Flying Carpet, that is the carpet who are flying, not you. And you do not gain fly speed. So I think you can't use spring attack.

Correct me if I am wrong...

but isn't fly by attack slightly different than spring attack. Nowhere in there does it state that you avoid attacks of opportunity with fly by attack. Just that you can perform a standard action at any point during the move.

PS - I am at work and my books are at home AKA my memory is fuzzy on that feat...

Nope, you're correct. Fly-by attack does not provide any protection against AoOs.

There's also Improved Flyby Attack, which lets you avoid AoOs for your flyby. I think it's in, hmm, Savage Species? It might appear somewhere else, though- I haven't checked it out in quite a while.
