There's also a power play in the recent dragon that mentions spring attacking. It specifically mentions sipping a potion/casting a spell, and "springing up", meaning by flight. I'm paraphrasing here...read the article for full text.

According to the description in MoTW, the feat Flyby Attack cannot be used in conjunction with magical flight (such as a fly spell).

It can if you use a spell to give yourself wings.
