In stormwrack suppliment they talk about using the Jump skill with swimming. Although I believe only with creatures that have a swim movement. In any case, they use it to leap out of the water. Shamu!

b) Nowhere in the wording of Spring Attack does it even allude to ground movement only

I'm going with this interpretation. Spring attack has higher requirements than Fly By Attack, doesn't list a movement type needed, and therefore I'd say you can use it while flying. And while swimming... and burrowing or crawling, assuming you could get a movement speed in one of those that would make the feat useful.

I also like FireLances point in support of this...

If that's not a weak position, I don't know what is. By this logic, you don't get Mobility while flying either. Or Dodge. What about Power Attack? Anyways, Flyby Attack allows attacks of opportunity, while Spring Attack does not. As others have mentioned, they do two similar but distinctly different things.
 

I say most definitley. IMO there shouldn't even be a fly by attack. But both have their advantages and I allow both:
Spring Attack: No attack of oppurtunity, can be used with any form of movement (which is in question right now).
Fly by Attack: You can take ANY standard action not just a melee attack in between moves. Only prerequisites is ability to fly (spring attack requires 2 feats, BAB and a good dexterity)

I'm going to go out on a limb here and point out that the feat also does not say that it can be used while using land based motion...
 

I'm pretty sure (though I don't have my books with me right now, so I can't say for certain) that there's an Improved Flyby Attack or maybe a Greater Flyby Attack that disallows AOOs while using Flyby Attack. Maybe it's in Draconomicon?
