Stand up from Prone without AOO

Prone Attack (S&F, updated for 3.5 in Complete Warrior) allows, among other things, a stand from prone as a free action following a successful melee attack.

Several PrCs have a stand-as-free-action class ability - the Thief Acrobat in Song and Silence, for example, has the Kip Up ability, which allows this.

Oriental Adventures and the ELH give stand-as-free-action a Tumble DC of 35.

None of these explicitly remove the AoO incurred for standing from prone. However, almost all of them (save the 3.5 Prone Attack feat) were written for 3E, when standing from prone didn't provoke an AoO anyway, so it's understandable that they don't address the issue.

Check with your DM if he's willing to insert the phrase "and does not provoke an AoO" into one or all of those abilities.

As written, however, they change the action required (Move -> Free), without altering the fact that standing from prone provokes an AoO.

Free Actions rarely provoke AoOs. "Rarely" means "sometimes".

For an example, see the Rapid Reload feat.

Casting a spell provokes an AoO. Casting a quickened spell does not... because the rules specifically state "Casting a spell with a casting time of a free action doesn’t incur an attack of opportunity." If this line didn't exist, and if the table didn't note that casting a quickened spell is "AoO: No", then it would provoke.

If you get to attack with a ranged weapon as a free action somehow, it provokes an AoO... unless the ability that allows it states otherwise.

Standing from prone provokes an AoO. If you get to stand from prone as a free action somehow, it provokes an AoO... unless the ability that allows it states otherwise.

And none of them do.

I allow a DC 15 Dex or Tumble check to stand up as a move action, without an AoO. We tend to forget this, though.
 


In our games we usually allow a "prone 5'-step" as a move-equivalent action, that does not provoke AoO, this usually allows to get out of reach and stand up by wasting an action, if you don't want to risk the AoO. Other than that, the DC 35 Tumble free stand-up (or any feat/class ability which does that) would also suffice.
