The Cleave Zombie

This is a potentially game-breaking combo... in the other thread on Cleave somebody said we should do a new thread about it so here goes:

You are going to face some high level minions, like a legion devil. So you get yourself a zombie minion (you either create one to serve you, or you just go on a zombie roundup and hogtie the thing). So you have a zombie minion in the square next to you (still hogtied, perhaps) when the netherworldly minion (or whatever minion) steps up to rumble. You then use Cleave on the hapless AC 13 zombie and instantly slay the mega-minion.

The bag of rats problem is also specifically mentioned in the DMG and anything that doesn't pose a significant threat to the party does not count towards fulfilling power conditions.

This is absolutely nothing more than the "bag of rats" trick gussied up in a slightly different package. It didn't work then, it doesn't work now

And even if the DM did allow it, how exactly is this "game breaking?" The entire point of minions is that they come in droves--what, are you going to carry around a dozen zombie minions and spend a half-dozen rounds setting them up just on the off-chance that you're going to face some legion devil legionnaires?

The article on minions specifically say the party is supposed to fight ones around your level.

On an unrelated note attacks with trigger conditions only go off when you attack a credible threat.

Isn't that precisely why they should have been on the lookout for it?
Good heavens mang. With your sig pic, I'd have thought you'd be first on the wagon when it comes to DMs being free to apply judgement, rather than relying on an exhaustive set of rules.
