Will you help my soldier/wife?

Most people don't think to go straight to the top, first - the idea of calling the President seems ridiculous. It isn't - he is still our employee, when all is said and done. Be polite but persistant. Breathe. And good luck. :)

I'm surprised the DAV gave you that answer.

I'll check in with a buddy of mine. He used to be an advocate for this kind of thing.

I'm pretty sure this is out of JAG's turf.

My buddy tends to take a few days to answer his email. I'll check back in when he does.

Thanks everyone. I have sent my wife's story to most of the senators on the militarty sub committees and to over half a dozen news agancies and four TV personalities. I'll be sending it out to more on Monday.

I'll give the president a try as well.

JAG says their hands are tied. They tell us we have another board we can appeal to, but we are still going to be kicked out with no benefits and we'll have to wait 18 months to 2 years to find out if they will take care of her. Now I will get to find out how the "system" works to keep us out iof bankruptcy in the meantime since we will go down to a one income family and all of our debt is based on having two incomes.

Hopefully this administrative board will rule in our favor, but I have no idea how long that will take or even if they will see our case in our favor.
 

Well, I got my first, and only, response so far from Sen. Akaka of Hawaii. He said since we are not a residence of his state he is passing our case on to a CA senator. I guess his position on an armed forces committee means nothing.
 


Our prayers to your family

You have made your appeal to the people that represent us, continue to do that yourself, also consider contacting your local government officials- the Govenator as well as your mayor, and city counsel. The more people that know of your plight the better off you will be in the end. Record the dates and times, and whom you have contacted, this could help you should you get onto TV, as well as make a dialog possible, this means save all your letters (received and sent).

I would most definitely make an effort to write letters directly to the people of direct interest- Senators and Representatives. Using their names will get their attention.

Do not sign anything- should someone suggest that your wife sign something, she needs to tell them “I need to have my attorney look at this first.” Hearing that she has an attorney and not just a JAG should make them concerned and give them a desire to ask you the all-important question- “what do you want to make this go away?”

Your wife should use a recording device when speaking to anyone that of authority about these matters or when these matters come up. Have her state plainly- “I need to get my digital recorder out to have this conversation or my attorney needs to be present.”

Log all conversations into a notebook, with anyone of authority, keep notes and things to help her recall things when she gets into a court situation.

My prayers go out to you and your family. I had hoped that our military had more respect for those that would sacrifice their lives for our beliefs. I suppose I was wrong however.

Did you contact the VA like they suggested? Their rating system isn't connected to the military at all. You don't see military doctors you see theirs, and they assign you a percentage of their own.
 

We are going to Camp Pendleton next week to meet with the Va and do an out-processing class that the Army offers. Of course the trip is on our own dime and on my wife's own leave, but her command has been nice enough to let her go before kicking us out. This is good since we are told by filing with the VA this way we will recieve a decision from the VA within 6 months instead of 16 to 24 months. We might not go bankrupt in that time frame.

Of course I have also found in Army reg 635-40 that my wife is supposed to be able to appeal the findings to an Army Physical Disabilities Appeal Board (page 26, section 4-25), now I just have to find out why no one, including JAG, seem to know about it.
