And yes I would go through the VA, their not the military and you and your wife's welfare now or in the future isn't going to cost them the money that they need/want to operative.

Unfortunately, not much i can do from the frozen northland but i have a sister in Colorado I'll forward your note to her and see if she knows anyone. Hang in there and best of luck.

If you haven’t already have her file unemployment, and you mentioned Fort Lewis so if she was stationed in Washington State have her file there if possible. If she’s an E5 she should max out the state benefits, second highest behind Michigan, she’ll need to send in resumes to varies companies a number of times a week but she can do that from the home computer.

She has the right to file in Washington State, or whatever state she was stationed out of, cause she’s getting out of the military… In Washington its about 460* a week, if you have them hold taxes which you DO want them to do, for 6 months.

* If I'm right and she maxes out unemployment.

If she's still on active duty, or is on termanal leave you can not file unemployment.

If she's still on active duty the two of you want to go to TAP, Transition Assistance Program, its invaluable.

Wish more people were taking interest in this thread. Treebore is a nice guy, have yet to meet his wife, but I have met their kids and they are pretty cool- very nice, respectful, and intelligent, so I can't imagine her being anything but kind.

Don't let this thread go by the way side EN Worlders- one of ours needs a little help and support.

I mean no offense by writing this, I just want to rejuzinate the thread a little on the list, keep it active so that others that have not read it will maybe read it.

Is your contact information still the same? Do me a favor and send a copy of your letter to me at phillipd "at" moaa "dot" org. We have a couple of experts on staff that might be able to give further guidance.

I do know that getting medical retirement ratings out of the services these days is like pulling teeth these days. You are likely to find a much more receptive audience with the VA, which currently pays up to $2,523 per month in non-taxable disability pay for a 100% rating (or lesser rating with unemployability) for veteran w/spouse and child (details Here)

I'll be sending you that e mail with my wife's name in the title.

I am aware of the VA, but I am being told they take 18 to 24 months. My wife cannot work. We are going to Camp Pendleton next week in hopes that time frame will be cut down to under 6 months. I can financially survive 6 months, maybe even 12. 18 to 24 I will go bankrupt.

Plus I talked to my wife's PEBLO today, he never heard of the board of appeals and is sending some kind of communication to the powers up above asking about it.

Got your note and am on the case. I spoke with our in-house expert on military medical board procedures and will talk to our VA expert here in a bit. I am also compiling a list of other resources that might be able to help financially during the time frame between discharge and VA findings. Keep in mind that even if she did receive a military medical retirement, the financial amount would not be very high and it will also be offset dollar for dollar by any VA disability pay she receives.

I don't know how long she has in, but assuming she is an E-5 (over 8), her medical retirement pay would be pretty limited (~ $450/month based on the current formula)...the VA Disability system is where the big money is.

I will call you later today when I have gathered more information.

My buddy weighed in ... I should warn you, his manner is blunt.

Sorry for not responding sooner. The DAV does assist personnel
getting out of service at the physical evaluation board (PEB) which is
held and conducted at Walter Reed Army Hospital all of the time! What
she needs to do is appeal the findings and demand a PEB to be judged
for fitness for continued active service and it will go to Walter
Reed. The DAV in Washington, DC is the office that needs to be
contacted, NOT THE LOCAL DAV OFFICES! They do not handle military
boards at all, so they do not have an understanding of what process
needs to be completed. The only thing they deal with is the VA.

Your friend [Treebore] may think that he is being swift, but he is only slowing
his chances of getting an evaluation board to review her case before
she is discharged. It is not uncommon for senators, military
sub-commitees, and even the president of the US to recieve massive
amounts of these sort of letters on any given day. (literally
thousands!) Of course they will tell her that there is no appeal
process, it's too much paperwork for them to perform! But if they did
some homework and learned what the actual process was, they would see
that there is always an appeal process available. It is when the PEB
comes back with a less than favorable answer that the final appeal is
with the Army Board of Appeals (also in Washington and also
represented by the DAV), which she has three years after discharge to
file such an appeal.
