I don't drink myself, but in my brother's game then tend to drink during the game, but there's been no problems.

In most of the games I play in, we do max at first level, then both the player & the DM roll, but the DM keeps his roll secret. Then the player has the option of keeping his roll, or going with whatever the DM got.
