D&D 4E 4E: What 3.x problem did it fix for you?

It would be an attack (not sure what type of attack) against fortitude. If it "hit". Then the character is frozen or immobile, or something else like that. But each round they would get a saving throw, which is just a d20 roll, and on a 10 or higher they shake off the affect.

Additionally if I were the designer I would have it do a certain amount of damage, so that if that damage ended up killing the character they would still end up as the classic stone statue.

Maybe this?

Attack vs. fortitude, on hit: turn to stone (ongoing 15 damage and stunned and immobilized (save ends both)), on miss: slowed. If creature dies while immobilized, creature's body remains a statue permanently.
