First things first: demon or devil? Text implies former, alignment suggests latter. It's appearance suggests demon to me.

Divide by 4.5 gives it 10 HD.

I'm guessing they were using "demon" colloquially. I like devil based on LE alignment, and I'm fine with weird looking devils. Aren't advespas and xerphylstyxes (spelling?) funny looking enough? :p

The darkness and fear suggests devil, though. We could make it a resident of Hell that isn't a true devil, though. A race of pests, perhaps? Or mercenaries? Or a subjugated race connected to the Ancient Baatorians or to a Material plane long ago subsumed by Hell?

I like the subjugated race, nice. Can it be a devil but not baatezu? I feel like there's fiendish precedent for something similar. Non-tanar'ri generic demons or something maybe.

Yep, it can absolutely be a devil and not baatezu (see also, chain devil).

Good call, Demiurge. This way they won't just be "lesser mariliths" in the Abyss.
