I'm not sure a static cap is the best idea, though. If you advance one quite a bit, 5th-level spells aren't quite as impressive. Is there a way we can tie it to the eater's Hit Dice?

How about HD/2 + 1. That would seem to mirror the cleric and wizard's progressions.

Acquire Skills (Ex): An eater of knowledge can acquire one skill known by a creature whose brain it has consumed, chosen at the time of consumption. It permanently gains all of the creature’s ranks in that skill (but not racial or ability score bonuses to the skill modifier) even if its new total is more ranks than the eater's Hit Dice would normally allow. This skill becomes a class skill for the eater of knowledge, and it may buy more ranks in the skill if the new ranks do not cause it to exceed the maximum ranks in the skill.

Acquire Feats (Ex): An eater of knowledge permanently acquires two of the feats of a consumed creature as bonus feats, provided it meets the feats' prerequisites.

Acquire Spellcasting (Ex): An eater of knowledge permanently gains the ability to cast the spells of a spellcaster whose brain it has consumed. The eater of knowledge is able to cast one spell of each level available to the character (if the victim was a wizard, the eater of knowledge must still consult a spellbook or learn from scrolls), as well as any bonus spells provided by the eater's ability scores. If the eater of knowledge already has spellcasting levels, these spells are in addition to those granted by the eater's spellcasting class levels.

If the victim prepares spells as a wizard, the eater of knowledge must still consult a spellbook or learn from scrolls. An eater of knowledge cannot spontaneously replace spells (like a cleric does with cure spells or a druid with summon nature's ally spells), nor does it gain access to any domain spells or powers.

We should also add an XPH section and add an Acquire Powers ability.

In addition to its stolen powers, the eater of knowledge can use the following powers, once per round, at will: confusion, detect invisibility, domination, ESP, forget, hold person, levitate, and shadow walk. Eaters communicate with a natural power of telepathy; their mental voices're a discordant chorus of every sentient creature they've devoured. The eater of knowledge is itself completely immune to any mental attacks or mind-affecting powers, including illusions and charm or hold effects.

Eaters of knowledge have the following psionic powers:
· Psyhcoportive – Sciences: probability travel. Devotions: astral projection, dimensional door.
· Psychokinesis – Sciences: telekinesis, disintegrate, project force. Devotions: animate object, control body, control wind, inertial barrier, molecular agitation, soften.
· Telepathy – Sciences: domination, mindlink, probe. Devotions: contact, ESP, inflict pain, invincible foes, invisibility, synaptic static.

I'd say SAs, since the infernal's spell suck ability (which allows it to steal spells) is a SA.

Hmmm...should we make some of these spell-like psionics, and then in the XPH section say that they manifest powers as 10th-level psions and give 'em a typical powers known list including some of the above powers?

BUT - is that the difference between stealing something from a living creature, and stealing something from a dead creature? ;)

rawkin... i was wondering if you thought those should be psionic in nature, or spell-like abilities, given that they are listed separately from the normal psionic powers.

A fair question, but since the ability itself is offensive, and the abilities gained will more likely be offensive, I'm still standing my special attacks. ;)

especially since it's likely that this thing will be using the stolen abilities as attacks...

one option would be to do as you say, but then would we have both spell-like abilities and psionics as the creature seemed to have had in 2E?
