Quite simply that 3e was not designed with the thought that one day it would be open. Meaning that they have a lot of work to check everything twice before handing it to the legal department.

d20 Modern was designed to become open from day one. Meaning parallel development of the SRD alongside the Main Rules.

You can use it, you just don't gain any benefit

Third party products help establish the game as a valid, popular, supported ongoing system. They drive sales of the core book - and that's good for WotC, who wants to sell as many core books as possible.

Remember, WotC has a less pressing demand to get other stuff in there. D&D is already established for 3rd party sources. But d20 modern has to be seen as a success for people to want to buy it! Lots of 3rd party products helps create that perception.

Having looked it over I have to ask:

Other than pretty pictures, flavor text, and the little campaign settings, is there any reason to buy the book now?
