Absolutely. Especially if you are a turning monkey. This breaks down if you have more that the "four encounters per day" routine, but otherwise, you bet.

Sure. And mysterious encounters can be tough. My advice to the DM would be to continue to use "mysterious" encounters but until he learns to judge the effects simply treat these encounters in his planning as 1 or 2 Encounter Levels higher than the CR's would suggest.
 

Side note, Knowledge: Nature or relevant ranger/druid should be able to identify that the Ape's were modified and/or unnatural.. so its not just the Cleric that got skipped...

Since they were evidently girallons (i.e. had four arms), they likely qualified as modified and/or unnatural apes without being undead ; )
