I misphrased myself slightly. The qualification for the ENnies is that a product bear the d20 logo. For everyone but WotC, that means using the d20 STL.

Kenzer & Company also can use the d20 logo in their products that bear the Dungeon and Dragons logo without having to put the OGL in their products due to the parameters of their licensing of the Dungeons and Dragons logo, IIRC.

I don't know the terms of their agreement that allows them to use the Dungeons and Dragons logo. It may be poignant to note that they produce minis as part of the Hackmaster line IIAKM, not as part of the Kalamar line (the latter of which uses D&D logo while the former does not).
