so if he's "only" attacking all that dodging and weaving isnt balancing but if he wants to take a 5 ft step he is?
if he is shot at and uses deflect/catch arrows or any dodge based ac booster its cool 'cos it isnt his action and he isnt trying to move?
mmm doesnt feel right. however having a first level spell that makes everyone flat footed and susseptible to sneak attacks is a bit much.

If he doesn't move from his square, he is not required to make a Balance check. Only a Reflex save each turn.
