Sure. The RAW also don't actually forbid sending a balor against a first-level party.

My DM weights it approximately by size, so yesterday I had a 1 in 4 chance of hitting the PC being carried off by a "bear-owl". I hit the PC. :o

A creature with Improved Grab can take a -20 penalty to Grapple checks in order to be considered ungrappled.

If it chooses to do the latter, it takes a –20 penalty on grapple checks, but is not considered grappled itself; the creature does not lose its Dexterity bonus to AC, still threatens an area, and can use its remaining attacks against other opponents.

If the bear doesn't take the penalty, then he's grappling for all purposes (including hitting the wrong target). If he does take the penalty, then he's not considered to be grappling.
