I think Hanlon’s Razor is a more likely situation.

I don't see their strategy as malicious, other than in the way the the normal functioning of capitalism can be seen as malicious, depending on context, and I feel it's too soon to label it as stupid. I think it's potentially a clever way to continue to effectively control the IP while technically sharing it. Might work. Might backfire.

In other words, I think it's an eat your cake and have it, too, strategy.
