Round 280: The chain-thing maintains the whirlwind.

Round 281: Rusty breathes and the chain-thing resists. It maintains the whirlwind.

Rusty can breathe again in round 284.

Rusty cannot afford to wait for his breath weapon (it would be a draw), so he hovers straight down 5ft and bites it! Then he continues his flyby attack and hovers back up again out of reach.

Chomping on the whirlwind 5 feet down is like chomping on one dagger in a blade barrier spell. It would have no effect. The real chain-thing is 20 feet down, looking delicious but very unwilling to be eaten.

Rusty lowers himself into the maelstrom and gets attacked by an AoO as he approaches the chain-thing. It misses.

Hover and wait until I can breathe acid. Keep breathing acid while chasing chain-boy around, until chain-boy gets the idea and flees. If chain-boy appears to be immune to acid, go down for up-close combat.
