Regardless of the rules interpretations...

Another fun thing for players who spam detect magic is to place magic where they don't expect it. For example, Sovereign Glue (a magic item) could be used to repair something relatively mundane, like a statue. Potions can spill and end up being tracked around on peopes shoes, leaving "magic" footprints. When a magic weapon is broken it is still a magic item, and pieces of a sundered bow or quarterstaff can look awfully strange so someone who doesn't know what it was originally. Any of these things, and countless others, can drive players crazy if they get too caught up in using Detect Magic.
 

I may have overlooked it, but did someone mention yet that warlocks do get Detect Magic at will for free IIRC?

Which is one of the basis for my conclusions (and opinions) (I have run a warlock in a game who did that).
In fact it is much more germaine and worisome than the OP's situation since in order to cast a permanent Detect Magic on himself the wizard has to be at least 9th level vice the 2nd level warlock.

Right. Big deal for a level 2 dude, no prob for a level 9 dude... there are so many dispel magics flying around at these high levels.
