My understanding is that if you copied the stat block verbatim (copy/paste) then you would be in violation, but WotC wouldn't care. If you re-wrote it (in a different format or perhaps even if you typed it up yourself and it appeared the same?) you would be fine. The only place of concern (to me), would be traits or abilities that are complete sentences. That might be an issue if you wrote up an ability description (unless an SRD monster had the same ability/trait).
