I have to disagree, it's evil as well as cowardly. They're feudal nobles, protecting the populace is the entire legal basis for their personal power. *Considers* I'd rule it actively chaotic too. Their standing in society is predicated on the notion that their personal fiefdom is theirs to protect as well as to rule. By failing to fulfill that duty on the one time in their entire lives they are actually called upon to do it they have completely negated the social contract that grants them their status. Frankly Hinjo should have the legal power to depose them for failing to fulfill thier duties. Or, given the 'japaneseness' of the setting, simply accuse them of cowardice publicly and they'll be forced to commit seppuku. :D

Except that they have stated a desire to protect the populace by negotiating with the guy who they have been told doesn't want to conquer them, just wants the Macguffin. Hinjo is the one wanting to sacrifice his people for something he values more than their lives.

I know the Order are the heroes and we all like Hinjo, but that doesn't make people who won't die on his unexplained sayso evil.

I might think that is his intent, but I still wouldn't necessarily trust his judgment.
 

Regarding Hinjo's oath and not telling the nobles about the gate: It wouldn't be a good idea to tell the nobles about it, even to get their cooperation in defending it. They've shown their self-centered motivations, and it is quite possible that one or more of them would get the same idea as Xykon and Nale -- "Maybe I can get some kind of power from using the gate myself."

So in this case, the oath of silence on the subject is actually a good one.

When this is all over, Hinjo should ban the fleeing nobles from ever returning to Azure City, and should give the Order of the Stick (the survivors) noble ranks to take over those ex-nobles' positions, previliges, and responsibilities.

After all, the OotS members are name level, right? :-)
