Not if he's balancing. That leaves you flat footed in 3.5. And Barbarians have Uncanny Dodge.

Makes for nasty Iaijutsu Masters in 3.5, if they can get you on a narrow ledge...

We really need to stick to 3.0 for this one - it's what the judgement was given for, and you can't really reapply it to 3.5. Why? Because the text for uncanny dodge in 3.5 is really unclear as to whether it benefits a blind person at all.
