I'd say DR 15/epic and good I get the idea that the chaos aspect of his alignment is less important than the evil. And I'd be more than willing to bump that up to DR 20/epic and good. More in tune with the 3.5 archfiends.

Agreed. Better to not have two alignment-based components.

also, i'm not familiar with the Improved Death Attack feat.
 

It's essentially Ability Focus (death attack)...

IMPROVED DEATH ATTACK [EPIC]
Prerequisites: Death attack class feature, sneak attack +5d6.
Benefit: Add +2 to the DC of the character’s death attack.
Special: This feat may be taken multiple times. Its effects stack.
 

is that from the same source as epic poison crafting?

Should his effective rogue and/or assassin level be equal to HD (for the purposes of things like sneak attack and such)? Does that put him over his CR? Should we put him over a level 20 character's abilities in that way?

You are right on the skill ranks, I'd drop 9 from balance.

The improved death attack is from the Epic level Handbook, i think (it is on the epic feats section of the srd at least)

That would be fine, and there is precedent...a gloom is able to sneak attack as a 25th-level rogue (and it has 25 HD).
 

OK, and a 36th-level rogue has sneak attack +18d6 as stated above? i could also use his 36th level for uncanny dodge and anything else that applies.

Shouldn't Craft(poisonmaking) be 61 (because of Epic Poison crafter), Jump +60 (39+5 str+12 speed, +4 synergy), Tumble 58 (39+15+4 synergy with jump), Use rope +25 (but +29 with binding (10+15+4 synergy with escape artist)), Survival +5 (+9 following tracks)

(Remember that you gain an extra +2 synergy bonus for each additional +20 ranks beyond 5 on the appropiate skill.)
