The difference is Magic Stone is technically usable the round it is cast, as a bonus action.

Sorry, my mistake. I forgot about it being a bonus action to cast. That makes it worth casting up to level 4. I'll edit to correct my post.

On that note, if Cobra's Spit was a bonus action to cast, that would make it more worthwhile.

Regarding lichmaster's comment about Cobra's Spit being a ranged spell attack, I think that's roughly on par in terms of damage potential with save for half damage (depending on target's AC and saving throws), so I don't think that makes it any better.
