Yup. And I'd handle it just as if the simulacrum started giving orders to the wizard's Loyal Henchman. If the LH knows it's not the real wizard, he might not obey. If he thinks it is the real wizard, he probably will.

Also, if Kermit counts as the sim's familiar, it shares spells with the sim and its previous master?

Sure. If either one is within 5' of Kermit, they can cast a spell that affects both the caster and the Toad.

Share Spells is a "power of the original".

Ah, so you'd just rule it that the original and the simulacrum share the familiar, rather than the sim getting his own familiar. That's an interesting take on it. Not the one I'd go with, but it'd work.

If there was a pre-existing familiar, yes.

If there wasn't, then they both have the ability "Summon Familiar", so they can both summon their own.
