Underwater Combat Issues? [My Players should know better]

Plotting out some issues with my campaign that aren't actually coming up in the near future time.

I have an advanced underwater creature (Kraken) that makes use of the Whirlwind Attack feat (specifically Improved Whirlwind from ELH). That gives him a 100 ft or so whirlwind attack in a 3 dimensional space region. Mostly I'm curious as to how I should approach the use of Whirlwind attack in a 3 dimensional combat environment (ie, a 2 dimensional disc, or a sphere?).

Mostly, having trouble with the Kraken's speed and Jet ability (the later being able to quickly outpace the players and allow the Kraken tactical advantage) in concert with the extreme range (And lack of viability of most ranged combat options -sans magic).

Clarification, mostly curious as to others opinions on Whirlwind attack in 3 dimensional space. Aside from that, I'm concerned over tactical dominance the creature may have due to Jet.

high move presents the same problems on land with a high fly speed....there is a reason it usually bumps the CR...having better tactical movement is always a large advantage.....
 

The Whirlwind Attack in my ELH is just like the 3.5 Whirlwind...

So has there been some errata type stuff in the conversion document on that?
 

Not to my knowledge.

Luckily I'm using the 3.0 ruleset, but I will most likly just trade the feats out when I go 3.5 with this campaign.

I'm leaning towards the Spherical Whirlwind really, but will be nice and not allow the ultra cheesy Great Cleave with the ambient wildlife in the vacinty (too much the bucket o' slugs for my tastes). That and the idea of a single creature turning the oceans of my world pink with blood is disturbing :).
