I would appreciate any comments/suggestions people on the following new spell:

Level: Sor/Wiz 2
Components: V,S
Casting Time: 1 action
Range: Personal
Duration: 1 hour/level (D)
Saving Throw: None (special)
Spell Resistance: Yes
This spell makes you both unnoticeable and forgettable. Normally creatures are not allowed a save to avoid either effect (see exceptions below). The spell ends immediately if you make any direct attacks.
The first part of this spell makes you unnoticeable. It doesn’t make you invisible, allow you to hide better, or move more silently, but it makes all living creatures ignore you. They can see, smell and hear you, but they just don’t care about your presence. Normally there is no save for this effect if you are acting innocuously, however see below for exceptions.
Several actions will provoke a will save from this effect. Once a creature makes a will save, they are completely immune to all effects from that spell, although the spell continues to affect others. The following actions will provoke will saves:
· Moving more than your base speed (-1 DC if 3x speed, -2 DC if running)
· Making a threatening action (-1 to -4 DC depending on how threatening the action is). This includes drawing a weapon (-1 DC), aiming a ranged weapon (-3 DC), moving within 5 feet of a creature while holding a weapon (-4 DC), etc.
· Casting a spell
· If the creature was actively looking for you before encountering you
· Violating someone’s job, or personal space (eg if you try to walk past guards who aren’t supposed to let anyone by, or you enter a someone’s house or a creature’s nest).
· Any action that draws undue attention to yourself.
Note however, that in non-threatening situations you can usually tap someone on the shoulder and talk to them without losing the effect of the spell on them or giving them a saving throw. It would be like “Oh, I didn’t notice you standing there, what can I do for you?”. Of course if you talk to them about something very disturbing they would get a save (DM’s discretion).
The second part of the spell makes creatures forget they encountered you. Note that this only works if they weren’t given a save or failed their save during the encounter. The forgetting effect continues even after the spell wears off (as long as the encounter occurred while the spell was active). If a creature is actively trying to remember whether they encountered you they receive a will save to remember, or if they are convinced that all the details of the time they encountered you are important. Otherwise they just forget having seen, heard or spoken to you.
