What CR should this be?

Okay, I modified an encounter so much...that it was no longer recognizable. :)

Here was the creature they were fighting

4 HD undead (39 hp)
DR 10/silver
full attack +5 (1D6+2) (one attack)
AC 14

So, about what CR would you estimate this as?

Thanks

Yeah a low 3 if that. While the Hit points and DR probably make it tougher then a ghoul, it is definetely not up to Ogre Standards.

Frankly I might rate it a CR 2, ghouls are scarier given paralysis.
This guy has a lot of hit points and is going to resist alot of damage but not really do much else. Kinda of a quick moving supped up zombie. The low AC will let people w/o silver weapons Power Attack and get some licks in.

CR 2

The AC suggests a CR2; the 4HD suggests CR2 (the actual rolled hps are irrelevant); the bab & damage suggests CR2; the DR suggests CR4 & the one quality of note is being undead.

I'll be generous to the players and make it a weak CR3 & they can pocket the extra XP.

Cool, I was thinking it was 4ish, but that is mostly due to the DR and HP. (the HP matter since this was creature 'made up', his HP are more typical of 5HD.) But in hindsight, it wasn't doing much damage either, so they were not in too much danger.

I will probably go with 3, since they were hard pressed to damage it. (I know, CR technically doesn't deal with 'difficulty', but that can be added on as a function of the encounter. I am just moving that step up a bit.)
