You are arrested and thrown in prison, what do you do now?

I play the cleric so it sounds like fun to me. That being said, the best solution is for everybody to get out alive. Another bad detail is that in the setting (a homebrew) arcane magic is illegal, punishible by death. The fact that they found 2 spellbooks really spells doom for us. I think our best possibility for success is to try to escape in transit from city1 to the capital where we are to be punished. Itll be interesting to see how this works out.

"Us"? Nono. This is all you need: "... Who? I don't know this guy! He kidnapped me/put me under a spell!"

Oh, you mean for active movement in escaping, I was thinking of listening for when the guard enters the cell.

Well, for any aspect of it. Also, to make sure the guard doesn't hit you when he's looking around the room.

It's a funny idea, though.

Heh, probably the best way to do it would be to throw some kind of Silent Image that showed one last party member walking into a glowing door, rather than shout "Hey guard, we're gone." That would be rather amusing, though.

I'm pretty sure this doesn't work on creatures. Only objects. If you put a mouse in your invisible pocket, for instance, it stays visible.
 

Get a good lawyer?

I mean it's pretty simple:
1. You beat the rap
2. You escape
3. You do the time
4. You do the time for whatever crimes you commit trying to escape as well--or get killed trying to escape.
5. Maybe you get sold into slavery instead of being put in prison. It may or may not be easier to escape as a slave than as a prisoner.

But, realistically, you guys are 4th level. You don't have any world-shattering powers yet so the jail is probably built to hold you pretty well. You might escape (some people manage it) but you probably won't. If every fourth level guy who wanted to escaped, there wouldn't be much law left.

If you're really innocent and the land is reasonably close to just, working within the law to get out is probably your best bet. If you're guilty and the land is incompetent or corrupt, finding some way to bribe or blackmail the judge is probably your best bet. If you're guilty in a just land or innocent and being railroaded/framed/etc then you'll have to take your chances and pick the best time to try and escape. Be patient though. Grabbing the guard's sword and running away may work in the short term, but it's not always your best bet.

The barbarian has one more rage for the day so I suppose that could work. The leader of the city is now a puppet of the corrupt church that wants us dead. Our wizard is an illusionist and doesnt have access to fly or invisibility at the moment so that hurts a bit. I think the worst thing is that we just got out of a battle. Unless we can come up with something pretty rad or we get some suprise help we will have to escape during transit or face execution. I dont believe that it will get to the point of death because we didnt do anything stupid to deserve that not to mention our DM wouldnt do that to us. Thanks for the ideas, keep em coming.

The wizard is an Illusionist?? What spells does he have left?

Many illusion spells will get you out of there...an image that one or all of you are dead comes to mind, or your cell on fire...does he have a Mage Hand left? Thats gotten me out of more Cells....
