Firstly, that might be a interesting encounter, but seems kinda boring. I like a mix of minions and stronger people. Nothings stopping you, but it is an odd fight. Yeah, your miss effect does nothing. One good hit, goodbye orc.

They didn't level to 9th, they are just there to kill at level 9. Monsters don't really level, I'm pretty sure no non-PC does. Makes more sense, anyway. Leveling is there to reward playing the game. Minions are not people, they don't need real lives if all they do is get killed by Cleaves, or the ranger does a spinning scimitar attack. Its silly to even care about what they do outside of combat. They are there to go splat.
 

Here's my reasoning why I would allow for a couple of them to take on PC's.

1) If the party is captured and locked in a camp with the minions as their guards. One possible way out is to fight them and they present enough challenge for the party to give them reason to consider other methods.

2) If the party comes back to the camp later (level-wise) to wipe it out, I don't have to change the mobs just to match the encounter.

It gives a very movie feel where the party starts out pushed around by them and later just walks through with little to no trouble.

But that's just me :)
