They intend to drop suit before discovery, and claim they were bullied out, effectively a PR victory with their fans?

Seriously, though, they can't just "drop" the lawsuit now. I mean, they could dismiss it, but the underlying issues remain. And if WoTC files counterclaims prior to the dismissal, then it's not up to nuTSR if the action is dismissed. Plus, dismissal means that the pending administrative proceeding ... proceeds.

In other words, they'd have to dismiss, get rid of the underlying issues (the trademark and copyright issues) and trust that WoTC doesn't sue them (or get an agreement). Which is possible, but if you keep poking a bear, eventually the bear is going to take a swipe at you.

My observations of these types of people is that their "truth" is the only thing they think is relevant. You can see this same type of behavior and thought process running rampant through many parts of society world-wide for years now. These people believe that the way they perceive the world is the only truth that matters, because they don't believe in or care about an objective truth.

Further discussion of the topic would run afoul of the rules, but ... yeah, I agree with you.
 

I don't know. Haven't gotten through Tenkar's video yet, but all I see on those Tweets are accusations and unproven claims. Where's the proof this person actually worked for NuTSR? Has s/he posted a paystub? Internal memos? Or just a bunch of claims that may or may not be true? What "proof" am I missing in those Tweets or elsewhere?

"Refusal to pay" doesn't mean just employees. For small companies, it's mostly freelancers rather than employees (although I think Michael was an employee??). So "refusing to play" could mean not paying Don Semora what he was promised, or not paying Ernie if he was owned anything, or Larry Elmore, or any other person they hired to do work for them. (thus the real reason for the fundraiser, I'm guessing)

Their actions make a lot more sense if we stop thinking of them as legitimate attempts to hold rights. I don't think they actually care about the action - if they lose the right to use the marks, they'll spin it to claim to be victims, which to them is a PR win.

If WotC sues, they hide behind an LLC that has no assets to speak of. Indeed, the stated plan for TSR3.5 seems to have been to allow others to do creative work, and license out their trademarks to the creators - which means they'd never really intended to have many assets. A few contracts, and that's about it. Most of the time they could take license income, quickly disburse it as salaries/bonuses, and not even keep much in the bank.

I don't expect LaNasa considered what might happen to them if WotC is really annoyed, and manages to also attach LaNasa personally to a suit. That sounds like the real failure point.

"do they think?" is always the most relevant question when it comes to these guys it seems.

Sometimes they feel like Blackadder and Baldric coming up with a plan so cunning it could be appointed professor of Cunning at Oxford university. I guess they might be thinking, but does it do any good?
