With Dall-E being presumably ethical (given that Microsoft leads an ethical training effort, it would be strange that they wouldn't comply with their own recommandations -- that, and their strength comes from a particularly well captionned data source, which reduces the need for a monstrously large database), Adobe being trained on images they acquired the licence for, and now Stable Diffusion 3 that says their new model is ethically trained, I think we can say that the time of theft accusation on training material is over, except for Midjourney among the large players.
 

I wouldn't put Adobe or MS in the good books.

MS is a huge funder of OpenAI behind the scenes and has access to GPT tech so they are benefiting from OpenAI larcenous training approach in some fashion. No telling what shenanigans they have around Dall-E.

Adobe didn't tell its Adobe Stock artists that it was using their art for AI training until after it was done. The legality of the licenses involved for the copyrighted works, especially those from several years back when the definition of "software artist tool" had a different meaning has yet to be proven in court. Adobe is trying to placate artists with a supplemental recurring revenue but it's as difficult to audit as any other "Transformer" model so I expect that to go over like lead ballon.
 


Safety is important. That’s why I wear my seatbelt. Without being safe, people could die or in other situations be born. It’s a dangerous world out there.

If SD3 can’t draw seatbelts, airbags, PPE, or other forms of safety. Is it really safe enough?
 

Yeah that announcement wasn't great.

But I am pretty sure a community finetune will greatly improve SD3's base model to render, erm, airbags. The community is extremely safety-conscious, after all.
