Statistically, it is guaranteed, if we're taking the averages, and you think a willful evil creature is going to continue to happily serve after it's been subject to Planar Binding? That seems ... generous.

Subtle Casting doesn't mean the nightmare doesn't notice it was being controlled. Subtle Casting only means that the nightmare (or any other observer) wouldn't see you casting it. Being bound by a Planar Binding spell is indisputably a perceptible effect to the creature being so bound, and an evil willful creature like a nightmare will indisputably resent being so bound.

So, are you falling, or are you riding an unwilling mount?

Failing to choose would, I'd say, constitute a forfeit.

Subtle Casting doesn't mean the nightmare doesn't notice it was being controlled. Subtle Casting only means that the nightmare (or any other observer) wouldn't see you casting it. Being bound by a Planar Binding spell is indisputably a perceptible effect to the creature being so bound, and an evil willful creature like a nightmare will indisputably resent being so bound.

The time to make that Charisma check was before you cast Planar Binding on it. But you've already declared it was subject to Planar Binding, so ... you didn't.

When Yuan-ti Sorcerer cast a visible spell against it.
Bastion says: "He's attacking you, let's beat him!" Persuation Check.
Nice try, but failed.
It's hostile agaisnt the Yuanti Sorcerer.
