This is a good point. However, it's a very strange situation, since a rogue can only use their weapon talent while making an attack, but the orb implement feature can be used as a free action at any time during the encounter.

I don't know if the rogue weapon "wield" definition can be used here, since technically you don't have to use the free action immediately. In fact, you could wait 5 turns after casting a power and then choose to use the orb - or at least, that's how it must work, or else the 2nd (useless) orb power makes no sense, since you could only usefully use that power on the turn -after- you've used an at-will power.

It seems like the only requirement to using the orb ability is to "wield" it, but at the same time you do not have to use the orb ability during the attack.

That's a good point. Since the feature Orb of Imposition isn't used as a power is being used, and is instead usable at some later point, then there is probably no requirement that the orb be wielded during the attack.

Also, the player's handbook isn't clear on what is and what is not wielding, as the word is used inconstantly to mean "holding" and to mean "attacking with".

I don't think the authors originally had any distinctions here.

On the other hand, I guess it could be argued that you needed to have wielded the orb to cast the spell, then later you can only use the implement class feature on a spell that you've cast with that orb? ??? That's a bit weird, though, since that means you could cast, drop the orb, move around for a couple rounds, and then use it - since you already wielded the orb in the first place. Unless you also have to be wielding it to then use it on a power you've wielded it for, using two different definitions of wield in the same requirement...

So here's my Cust Serv question and response, which will undoubtedly change no one's mind but does fall in line with the original interpretation of this thread. End result: hooray no double feat tax!

If a wizard has the second implement feat so that they have both the staff and orb implement class feature and is wielding both a staff and an orb, can the wizard cast a spell through the staff and then later use the orb of imposition power as a free action on an enemy affected by the spell? For example, can a wizard cast "sleep" using the staff, and then choose as a free action to give a penalty to saves (orb class feature) to one of the targets of the sleep spell? Thank you.

You can cast a spell though a staff and then later use Orb Mastery to effect the spell because Orb Mastery does not require you to cast the spell with the orb to be effective.
