Ignoring your inflammatory tone, If "you can't move to avoid a blow" then you are effectively have a dex of 0 because wait for it.... wait for it....
Having a Dex of zero doesn't mean your eyes don't blink or you stop breathing. But it means "you can't move to avoid a blow." You know what else can't move to avoid a blow? My chair, my microwave, a telephone pole, etc. All these things have an effective Dex of 0. Guess what. I didn't write the rules. That's why the rule, as written, is ridiculous.
No, the rule as you interpret it is ridiculous. If you'd actually read the rules properly, you'd note that you also 'can't move' if you fail a Balance check by less than 4, but this doesn't make you flat-footed. There's no significance attributed to the statement 'can't move' at all.
Prove it? Your opinion on the matter proves nothing. Prove the game is less "balanced" by showing me stats which support your claim. Back it up with objective facts taken from hundreds of samples which prove "balance" one way or the other.
Well, ridiculous burdens of proof right off the bat, eh? You certainly seem to love underhanded debating tactics. I wasn't offering my opinion. 'Hundreds of samples' is a stupid way to prove anything. Logic is a much better tool. We have two stats, Dex and Armour. One adds to armour under circumstance X (not flat footed), and the other under circumstance Y (not touch attacks). The change you're proposing means that one adds to armour under circumstances X and Y, and the other under circumstance Y. If circumstances X and Y occur with unequal frequency, it's irrelevant, because X or Y is always more frequent than Y alone. Dexterity (and dodge bonuses) is now strictly better than armour because it does the same thing and under more circumstances. This is before you consider that armour reduces speed and gives a penalty to several skills while Dex increases Reflex saves and Initiative (One of the most important stats). And that abilities that let you keep Dex when flat-footed are more common than ones which let you add your Armour bonus to Touch AC (None in core. There's one in Races of Stone, which has a crappy prerequisite and requires you to be psionically focussed, meaning ranks in Autohypnosis).
Then you seem to blather on for paragraphs about nothing in particular, mainly talking about the balance of Strength-based builds over Dex-based builds which has nothing to do with anything, and looks to me like a cheap way of changing the subject to something else you think you're more likely to be able to 'win'.
