Does "when you fight this way" refer to "wield a second weapon in your off hand" or "get one extra attack per round"?
It's not clear.
Frank interprets it as "unless you utilise that extra attack, no penalties".
The 3E Main FAQ, however, notes that you cannot gain the AC benefit of a Defending weapon held in your off-hand unless you incur TWF penalties...
even if you make no attack with that weapon.
So, in that case, they're interpreting it as TWF penalties applying for making use of an off-hand weapon, not just for using the bonus attack that attacking with two weapons allows.
Since "fight this way" is not defined clearly, to declare that alternating attacks without incurring penalties "is legal" requires further argument.
