Help boost Con. to astonomical proportions?

Hinges on DM interpretation of "fighting in this way".

Especially now that Ambidexterity is subsumed into TWF. I like the fact that the style requires one less feat now, but... ambidexterity being gone is rather odd to me.

Uh?

That doesn't actually affect my point at all.

"If you wield a second weapon in your off hand, you can get one extra attack per round with that weapon. You suffer a –6 penalty with your regular attack or attacks with your primary hand and a –10 penalty to the attack with your off hand when you fight this way."

Does "when you fight this way" refer to "wield a second weapon in your off hand" or "get one extra attack per round"?

It's not clear.

Frank interprets it as "unless you utilise that extra attack, no penalties".

The 3E Main FAQ, however, notes that you cannot gain the AC benefit of a Defending weapon held in your off-hand unless you incur TWF penalties... even if you make no attack with that weapon.

So, in that case, they're interpreting it as TWF penalties applying for making use of an off-hand weapon, not just for using the bonus attack that attacking with two weapons allows.

Since "fight this way" is not defined clearly, to declare that alternating attacks without incurring penalties "is legal" requires further argument.

I would say that it "incurs" further argument.

Noone seems to have a problem with people throwing weapons without suffering the TWF penalties, for example. The rules have no provision for slapping you with penalties simply because on attack A you used weapon A and on attack B you used weapon B.

No, not at all.

What they do have provision for is slapping you with penalties because on attack A you used weapon A and on attack B you used "a second weapon in your off-hand". In other words, if you "fight this way".

Generally if you throw five daggers with Rapid Shot and Quick Draw, they're all thrown with the same hand... which does not fit the definition of "fight this way". (That is, either reading of "fight this way".)
