improved invis fix.

While reading the Haste poll I thought of another spell that gives me problems (BTW I have no prob with haste). I think improved invis is fine, except for one thing. A high level thief (or even low level) using it to make each attack a sneak attack.
I thought of a solution for this. If someone is fighting defensively, they can not be sneak attacked by an invisible foe if they are aware of the foes general location. In order to be aware, they must have made a listen check, or been attacked by the thief in the last two rounds.
What this does is eliminate the invisable thief from getting his SA every round, no mater what his opponent does. It still allow the thief to step back though, and come at a different angle as long as he gives his opponent a round to lose track of him, and providing he can sneak back. It also make the opponent take a -4 for all attacks, even against other opponents, so his isnt getting a round free for nothing.
opinions??
Also this does not work against a thief who is flanking him. The thief would still get his SA because of the flanking. It works only agains invisible thieves. (or thieves in melee who are howhow unable to be seen)

I really don't think it is a problem. Invisibility is so easy to get around at high levels its negligible. Same thing goes for sneak attacks. Any form of concealment (Fog, darkness, Blur) cancels sneak attacks. Lots of creatures are immune to sneak attacks.

Yea: everyone stupid enough to be unprepared against an invisible foe deserves all those sneak attacks by the thief - or any other rogue type.

Rogues are balanced with the intention that they get their sneak attack almost all the time.... not really a large problem, they don't last long in a melee, even when invisible (particluarly if you have blindfight)

I have to disagree. They are balanced with the assumption that they get their sneak attack often, but not always. Sometimes, they can't apply the tactical means to get into position, and other times, the enemy is simply immune. A rogue that sneak attacks all the time will be extremely powerful.

Invisibleness is strong and popular. So are the countermeasures againt it.

Rogues

That reminds me, I decided to develop weapon enhancement that would pierce critical resistance granted by magic, but not creature type.

+1 Lower critical resistance by 25%
+2 Lower critical resistance by 75%
+3 Lower critical resistance by 100%

Since I'd like a high-level rogue to have a change at using his sneak attack after level 15 when every enemy is either undead, construct, vermin, uncanny dodger or wearing Fortified armor... :)

Also I'm thinking of allowing Xenoanatomy feat that lets you choose one type of enemy that is immune to criticals and lets you critical it, if you attack with appropriate weapon (DM decicion).
