Even a high level rogue can be sneak attacked if stunned or helpless. With mediocre Will and Fort saves, stunning is not really that rare.

Theorectically a higher level rogue could also do the job from flanking. That will almost never occur with a single classed rogue, but it could easily happen to a multiclassed one.
 



The DM should tell the player if his rogue cannot sneak attack because of non-magical reasons. The main reason sneak attacks work is because the rogue is able to discern vital locations. In other words, the rogue would know if he could discern them and therefore the player should, too.

I agree, though in the case of a startling real-looking construct or a very lifelike undead the rogue might not know until he sees the effect of a wound.

Fair enough. Makes good RPG fun, too (if used sparingly).
