With the execption of flanking, are we saying that a 3rd level rougue can never be the victim of a sneak attack?

doktorstick said:The DM should tell the player if his rogue cannot sneak attack because of non-magical reasons. The main reason sneak attacks work is because the rogue is able to discern vital locations. In other words, the rogue would know if he could discern them and therefore the player should, too.
