"Phantom Steed" work in combat?

Could someone use a phantom steed in (melee) combat? I suspect you could (its magic after all and won't panic). I know that it won't fight as it says in the spell description.... but otherwise any problems with this?

A once or twice a day phantom steed item is a nice thing for an adventurer doing dungeon crawls and specializeing in mounted combat.

What I'd rule.

Shouldn't be any problem at all, as long as the steed doesn't fight.
