Sunder is not really abusable. It's just too weak a tactic.

It is a big deal because the DM's plan for his favorite medium-size weapon-wielding BBEG can 'sundered' with a single action. Most DM's prefer their BBEG's to go out with a bang, not with a weaponless whimper.

If they specifically protect their vulnerable BBEG's against this tactic, they take away one of the few times that Sunder can be really useful.

Your solution also sounds a bit adversarial to me, BTW.
