For using an Action Point to recover a “limited resource” does this allow spellcasters to regain spells?

i.e.

A wizard is out of 3rd-level spell slots. But uses an Action Point recovers a third-level spell slot, and then casts another Fireball.

Honestly the rules are not 100% clear as I read them, but I'd say they're 95% clear that the answer is yes. It clearly is within the intent of the rule and is not an overpowered use. If anything, given that the same action point combined with a short rest could recover a whole bunch of spell slots, the use you're proposing is suboptimal and only for truly desperate situations.
