It's easy to explain why the penalty happens. The item is drawing on you in order to power its abilities, hence the penalties.

Implementing it may take a little bit of work though since some of the abilities that you get at the end are much more powerful than those in the beginning. I may mess around with this a little and see what I can do.

It's quite a problem with "static" items.

Take Caput Mortuum (page 51). It's really just a scythe. The one activated power it has, "unseen servant", really doesn't warrant a penalty being imposed just because you used it. :)

FYI,
each level 5-10 is worth 2,000 GP
each level 11-16 is worth 8,000 GP
each level 17-20 is worth 40,000 gp

or close enough. If you want to replace penalties with the actual gold cost, those figures work very well as approximations.

True.

In cases like that, I'd establish a baseline - +1 vicious scythe - and allow the penalties to boost its power for the day. Expend 6hp, a 2nd level slot and accept a -1 attack penalty, and it becomes a +2 vicious scythe for the day; expend a 3rd level slot and it becomes a +3 vicious scythe, etc etc.

Or, more likely, I'd use an item that wasn't so boring.
