That's not actually how the rules work. There are zero rules exempting psychic spells from normal combat rules.

Yeah, I guess a DM can decide that a magic missile hit Yeenoghu in the eyeballs and exploded his brains, too.

This was not in my favor. It is the obvious my friend. You are suffering no visual mental damage, the enemy is imperceptible to you. What do you do.

I agree it was generous, although I actually agree with Hohige that Subtle Mind Spike wouldn't automatically reveal the location that you are hidden at. The enemy would need to actually look for you.
 

Psychic damage is not visually easy to identify and no, he does not know that he is being attacked if the spell is imperceptible.
But he's taking psychic (mental) damage, and if he's an oni, he's aware of magic and he's going to figure out that someone somewhere is hurting him. If he can't find that person, he'll plausibly assume gaseous form and leave. The fact he can become invisible won't help him, but he might not realize that.

That's not the issue. The issue is the DM decided the oni didn't realize he was being attacked, at all.

It was extremely in your favor. If something is losing hit points, that's something it's going to notice. Oni are intelligent enough to actively look around, and if they can't find something, leave.

Or, maybe just drop a cone of cold in a random direction, then leave.
