If there is a save involved, you always get to make one, unless you voluntarily give up your save and accept the spell's result.

otherwise, a mean DM could say 'well, those new pants you bought are too tight, and don't give you room to move, so no Reflex save for you from this Fireball. Bwahahaha!'

As for Evasion in a grapple, how many movies are there out there that the good guy is wrestling with a bad guy over a gun or whatever, even if the good guy is stuck in a choke hold, and the bad guy's buddies open fire, only to have the good guy twist out of the way and use the bad guy for cover, avoiding the spray of bullets? In d20 modern, avoiding autofire is a Reflex save for half, and some characters have Evasion. Different game, yes, but they're built on the same set of rules.
 



I really think the term "grappled" is a misnomer, when in a grapple you are grappling not grappled, you have as much control of the situation as your opponent and are free to move within the grapple so you should be just as able to avoid a fireball. pinned is obviously different.
