Well, for starters, the power levels are quite different.

Among other things. The Cr's aren't really what's important, as most DM's (like me for example) will add several class levels to the enteties anyways. But also when it comes to balance, one just have to look at the funtamental differences between the ToH Orcus and the BoVD Orcus. Both have their strong points, but the BoVD version is just more playable in most campaigns. (I still prefer the stats of the ToH version though, but then again I am an evil DM )

Well, leo, I suggest you open up your copies of ToH and BoVD and look for yourself. There are many differences, such as the DR, SR, Resistances, Immunities, HD, Abilities, Feats, and specific abilities. All and out making the ToH version quite a lot more powerful. A lot more powerful than it needs to be. The BoVD version on the other hand, could use a little boost, but any selfrespecting DM would have added classlevels to that version anyway.

Amen to that! Also, it's amazing what swapping out a few feats for epic feats can do to power them up.

so you'd rather have a weaker version of orcus rather than a more powerful one?

Look these guys are bad, mean, and CR in the higher 20s and 30s hell 40s if needbe! Make these things waltz over every living thing on the face of god's green earth. These guys are bad and eat PC's for a living, I say make them as such, giving them anything less than CR 30 is a disrespect for these things.

Jubilex is a CR 20 BoVD, in ToH he's a 28!?!? bigggg difference.

Make them crush all beneath them necromancer style!

right right, I'm all for going one step further in these and doing PrC's and godlike powers granted and spheres of stuff for these guys, hell it might be a bit of fun to do it too!
