I would say yes, because expending a charge is how you cast the spell from the wand. But it's a touch spell; if he's not there to be touched, then the charge is held for the next round. Let's see what Rystil says, though.

OOC - strange that I dont remember this ever happening in a home game I played in. and if it was a ray from a wand I would agree 100% and say the charge is expended, but I just envision with a touch spell, you would trigger the release of the charge once the wand meets resistance from the creature. But I suppose I can see this going etiher way as well
 

As the DM for that home game, I would first say that the miss chance is 01-50 on a d100 (a 50% chance to miss) and a touch spell isn't expended if it doesn't touch something because touch spells allow you to hold a charge. The same holds true for all touch spells that I can think of.
 

(OOC: You guys are totally right about keeping it on a miss chance or a missed attack. However, incorporeal creatures actually don't have a miss chance. Instead (direct quote--)
