No, the abstraction you must satisfy is "fight with two weapons". The legal fiction is used in support of that.

So if my first attack with the whip provokes an AoO, which the opponent takes as a Disarm, provoking an AoO which I take with my scimitar... then I'm fighting with the scimitar and may make my three attacks with the whip?
